Terms and Conditions

1.      Information on how to participate in this Offer forms part of these conditions. By completing the survey and registering for this promotion, or taking any steps to claim, redeem or use the Offer that is part of this promotion, participants accept these Terms and Conditions.

2.      This Offer is only available for eligible Participants during the Promotion Period.

3.      For the most accurate site prices, please refer directly to the Fuelcharge App. Some fuel price comparison apps aren’t accurate.

4.      This Offer is limited to a volume of 500L total for the duration of the Promotion Period.

5.      Survey responses and registrations are deemed to be received at the time they are received by the Promoter’s database and not at the time of submission by the participant. The Promoter has no control over communications networks and is not liable for any problems associated with them due to traffic congestion, technical malfunction or otherwise. The Promoter is not liable for any consequences of user error including (without limitation) costs incurred. Participants are responsible for their own costs associated with accessing the internet and claiming the Offer.

6.      Any failure by an individual to complete all the mandatory fields when completing the survey or registering with the Fuelcharge App, will prevent them from being able to participate in this promotion. The Promoter is not liable for late, lost, incomplete, misdirected, incorrectly submitted, delayed or illegible registration or claims for the Offer due to error, omission, tampering, theft, destruction or otherwise.

7.      The Offer is not exchangeable or transferable or redeemable for cash and cannot be used with any other offer.

8.      The Promoter may require the Participant to provide proof of identity, proof of age and proof of residency. Identification considered suitable for verification is at the Promoter’s discretion.

9.      The Promoter’s decision is final and no correspondence will be entered into.

10.   The Offer is not transferable or exchangeable and cannot be redeemed for cash. The Promoter accepts no responsibility for any variation in Offer value.

11.   If the Offer is unavailable for any reason, the Promoter may substitute for that Offer another item of equal or higher value as determined by the Promoter, subject to the approval of the relevant gaming authorities if required.

12.   The Promoter and its associated agencies and companies will not be liable for any loss (including, without limitation, indirect, special or consequential loss or loss of profits), expense, damage, personal injury, illness or death which is suffered or sustained (whether or not arising from any person’s negligence) in connection with this promotion or accepting or using any offer, except for any liability which cannot be excluded by law (in which case that liability is limited to the minimum allowable by law). Nothing in these conditions restricts, excludes or modifies or purports to restrict, exclude or modify any statutory consumer rights under any applicable law including the Competition and Consumer Act 2010 (Cth).

13.   Without limiting the previous paragraph, the Promoter and its associated agencies and companies will not be liable for any damage, loss or delay in transit to the Offer. The Offer will be delivered in Australia only.

14.   The Promoter may communicate or advertise this promotion using Facebook or other social media channels. However, the promotion is in no way sponsored, endorsed or administered by, or associated with, Facebook or other social media channels used.  Participants are providing their information to the Promoter and not to Facebook or other social media channels. Each participant completely releases Facebook and other social media channels from any and all liability.

15.   If for any reason any aspect of this promotion is not capable of running as planned, including by reason of computer virus, communications network failure, bugs, tampering, unauthorised intervention, fraud, technical failure or any cause beyond the control of the Promoter, the Promoter may in its sole discretion cancel, terminate, modify or suspend the promotion, or invalidate any affected entries or registrations, subject to the approval of the relevant  gaming authorities if required.

16.   The Promoter is not liable for any tax implications arising from the offer.  Independent financial advice should be sought. Where this promotion involves, for GST purposes, supplies being made for non-monetary consideration, participants will follow the Australian Taxation Office’s stated view that where the parties are at arm’s length, goods and services exchanged are of equal GST inclusive market values.

17.   IOR Privacy Collection notice: The information requested in the Fuelcharge app or in these Terms and Conditions is being collected by IOR Pty Ltd to improve its products and services and so that you can participate in the Offer. Without this information, the Promotor is unable to process your entry or registration. We may collect your personal information or disclose your personal information to its related companies, contractors and agents for the purposes of conducting this promotion, storing data, communicating with participants and to improve its products and services. By registering for this Offer, you consent to the storage of your personal information on the Promoter’s database. The Promoter, its related bodies corporate, agents and contractors may use this information for future promotions and marketing purposes regarding its products and services, including contacting the participant via electronic messaging. We will not disclose your personal information to a third party for that third party to send you its marketing material unless we have obtained your consent. Your personal information is managed in accordance with IOR Pty Ltd’s Privacy Policy.  This sets out how you may seek access to and correction of your personal information and how to make complaints. 18.   Fuelcharge Privacy Collection Notice: The information requested in the Fuelcharge app or in these Terms and Conditions is being collected by Fuelcharge Pty Ltd ACN 616 990 339 to improve its products and services and so that you can participate in the Offer. This includes facilitating payment of your diesel fuel at Fuelcharge supported diesel fuel sites. If we do not collect this information, we may not be able to provide you some or all of the services we offer on the mobile app, including to facilitate payment of your diesel fuel. This privacy notice sets out how Fuelcharge Pty Ltd ACN 616 990 339 collects, uses, shares and protects any personal information that you provide when using the Fuelcharge App. By sharing your location with the Promoter through the Fuelcharge app, you acknowledge that we may use and disclose your location information to:

a)    Identify Fuelcharge supported diesel fuel sites near you and facilitate the provision of diesel fuel and payment.

b)    Provide you with service updates regarding specific locations.

c)     Personalise your account and user experience.

d)    Send you alerts or notifications on diesel fuel prices and related offers and rewards near you.

e)    Understand users’ transactions and improve our products and services.

f)      You can update your location sharing preference at any time in your device’s settings. If you disable location services, you may not be able to utilise some or all of our services that rely on location services.

g)    If you wish to stop receiving notifications from the Promoter, you can also update your notification preference in your phone’s settings or disable notifications in the app.
